1. Sponsor:
Level Up RN 5-A-Day Pharmacology Challenge: Immune Medications (the "Challenge") is sponsored by Level Up RN, 2101 Las Palmas Drive, Suite B, Carlsbad, CA, 92011 (the “Sponsor”). The Sponsor is responsible for all aspects of the Challenge. Participation in the Challenge constitutes the participant's full and unconditional agreement to these Official Rules, and Sponsor’s decisions, which are final and binding in all matters related to the Challenge.
2. Eligibility:
Eligible Challenge entrants are only those persons who are legal residents of the United States, over 18 years old at the time of signup. Persons signing up must be legal residents of the United States and over 18 years old at the time of submission. Employees of Level Up RN (the "Sponsor"), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Challenge. The Challenge is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law, rule, or regulation.
3. Challenge Period:
The Challenge begins on September 23, 2024 at 6:00 AM and ends September 27, 2024 at 11:59 PM (the “Challenge Period”). All online Challenge activities must be completed by September 27, 2024 11:59 PM. All times are (GMT-07:00) Pacific Time (US). Challenge activities completed before or after the Challenge Period will not be eligible to win. Sponsor’s computer is the official timekeeping device for the Challenge.
4. How to Enter:
The Challenge must be entered by submitting a sign up form at https://leveluprn.com/pages/the-five-a-day-challenge. The participant must fulfill all Challenge requirements, as specified, to be eligible to win a prize. Signups that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Level Up RN.
4.1 Pre-Challenge Referral Bonus
After signing up for the Challenge, Challenge Entrants will be shown a referral link. This referral link can be used for the Challenge Entrant to refer friends, fellow nurses, or fellow nursing students, to sign up for the Challenge. The Sponsor will track successful signups for each user's link, and at the end of the Challenge Signup period the three (3) users with the most successful referrals will win a pre-challenge prize from the sponsor valued at up to $69.95.
The Pre-Challenge Referral Bonus Period begins on September 12, 2024 at 3:00 PM and ends September 22, 2024 at 11:59 PM.
4.2 Successful referral
A successful referral is an Eligible, Qualifying Submission who uses someone's referral link to sign up for the Challenge during the Pre-Challenge Referral Bonus Period. To be considered successful, the referred person must submit the form with a valid name, email, phone number, and other details, that are accepted by the form.
Signups that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Level Up RN.
5. Qualifying Submissions:
This Challenge is open to US Residents only. Not available where prohibited by law.
5.1 Challenge Entrants
A Challenge Entrant is someone who signs up for the challenge on the aforementioned signup form and meets the eligibility qualifications in the Eligibility section of this document.
5.2 Challenge Participants
A Challenge Participant is someone who logs into the Learning Platform and completes at least 1 chapter or unit of Challenge content, including watching video(s) and completing quiz questions, and meets the eligibility qualifications in the Eligibility section of this document.
5.3 Challenge Finishers:
A Challenge Finisher is someone who completes all of the Challenge activities, including watching EACH DAY'S video(s) and completing EACH DAY's quiz questions, within the Challenge period, and meets the eligibility qualifications in the Eligibility section of this document.
6. Judging:
The Grand Prize Winner will be the top-scoring Challenge Finisher. In the event of a tie, our panel of judges will choose the Winner from the pool of top-scoring Challenge Finishers by considering their entries from the daily Photo Contests as well as their interactions on the Flashables flashcards that are provided for the Challenge. Second Prize will be awarded to all Challenge Finishers. In addition, one qualifying Challenge Participant will be chosen at random to receive the Challenge Raffle Prize. Judging will be conducted by a panel of judges including Cathy Parkes BSN, RN, CWCN, PHN and other associates of Level Up RN.
7. Prizes:
The approximate retail value of all prizes is approximately $8241. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and local taxes shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winners is permitted. Winners are encouraged to contact their tax advisor regarding proper tax treatment. Acceptance of prize constitutes permission for Level Up RN to use the Winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
8. Winner Notification:
Winners of the Challenge will be notified via email or phone to the email address or phone number they entered into the Challenge within ten (10) days following the Winner selection. Level Up RN shall have no liability for a Winner's failure to receive notices due to Winners' spam, junk e-mail or other security settings or for Winners' provision of incorrect or otherwise non-functioning contact information. If the selected Winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate Winner selected. The receipt by Winner of the prize offered in this Challenge is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE CHALLENGE AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
9. Rights Granted by you:
By entering this Challenge you understand that Level Up RN, anyone acting on behalf of Level Up RN, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and Winner's name, portrait, picture, voice, likeness, image or statements about the Challenge, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
10. Terms:
Level Up RN reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Challenge should (in its sole discretion) a virus, bugs, non-authorized use of artificial intelligence, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Challenge. In such a case, Level Up RN may judge submissions from all eligible Participants received prior to and/or after (if appropriate) the action taken by Level Up RN. Level Up RN reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the signup or entry process or the operation of the Challenge or website or violates these Terms & Conditions.
Level Up RN has the right, in its sole discretion, to maintain the integrity of the Challenge, to void Participants and their activities for any reason, including, but not limited to; multiple signups from the same user from different IP addresses; multiple signups from the same computer in excess of that allowed by Challenge rules; or the use of bots, macros, artificial intelligence, or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Challenge may be a violation of criminal and civil laws and should such an attempt be made, Level Up RN reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the Challenge you agree to receive email communication about the Challenge each day during the Challenge AND email newsletters periodically from Level Up RN. 11. Limitation of Liability:
By entering you agree to release and hold harmless Level Up RN and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Challenge and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the signup or entry process or the Challenge; (v) electronic or human error which may occur in the administration of the Challenge or the processing of judging winners.
12. Disputes:
THIS CHALLENGE IS GOVERNED BY THE LAWS OF UNITED STATES AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Challenge, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Challenge, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Challenge), and participant further waives all rights to have damages multiplied or increased.
